dc.description.abstractİhmal ve istismar tüm canlıların maruz kalması muhtemel bir olgu olup nedenleri ve şiddeti değişmekle birlikte buna en çok maruz kalan kesimlerden biri yaşlılardır. Yaşam süresinin uzaması ve yaşlı nüfusun büyük bir artış göstermesi ihmal ve istismarın dikkat çekecek seviyede artmasına neden olmuştur. Özellikle son yıllarda üzerinde çokça durulan ve çeşitli sosyal bilimler ile sağlık alanında incelenen, tartışılan ve çözüm sunulmaya çalışılan ihmal ve istismar konusu bu makalede İslâm hukuku perspektifinden ele alınarak İslâm hukukunun meseleye bakışı ve bu tarz durumlar için almış olduğu tedbirler irdelenmeye çalışılmıştır. Birçok alanı ilgilendiren bu kompleks meselenin, insanların tutum ve davranışlarına etki eden ve yön veren din açısından da ortaya konması meselenin çözümüne katkı sunulması bakımından önemlidir. İhmal ve istismar çok boyutlu olmakla birlikte araştırmanın yaşlı bakımı çerçevesinde sınırlanması uygun görülmüştür. İhmal ve istismarın tanımına, nedenlerine ve türlerine yer verilen makalede İslâm hukuku açısından yaşlılara karşı takınılması gereken tutumun nasıl olması gerektiği, ihmal ve istismarı önleyici hukukî prensipler ile alınması gereken tedbirler tespit edilmiş, İslâm’ın şiddetin hiçbir türüne, ihmal ve istismara fırsat vermediği görülmüştür.en_US
dc.description.abstractNeglect and abuse is a phenomenon that all living things are likely to be exposed to, and although the reasons and severity vary, one of the groups most exposed to neglect and abuse is the elderly. The prolongation of life expectancy and the large increase in the elderly population have led to a remarkable increase in neglect and abuse. In this article, the view of Islamic law on the issue and the measures it has taken for such situations have been tried to be examined and discussed by considering the issue of neglect and abuse, which has been discussed in the field of health and various social sciences in recent years, from the perspective of Islamic law. As a matter of fact, it is important to present this complex issue, which concerns many areas, in terms of religion, which affects and directs people's attitudes and behaviors, in the sense of contributing to the solution of the issue. Although neglect and abuse are multidimensional, we found it appropriate to limit our research within the framework of elderly care. In this article, in which we present the definition, causes and types of neglect and abuse, the attitude to be taken towards the elderly in terms of Islamic law, the legal principles to prevent neglect and abuse and the measures to be taken have been determined and also ıt has been understood that Islam does not allow any kind of violance, neglect and abuse.en_US
