| dc.description.abstract | Geçmişten günümüze Balkan Devletleri arasında bir dizi sorunlar yaşanmaktadır. Daha çok taraflar arasında etnik ve dini kökenli uyuşmazlıklara dayalı olarak karşımıza çıkan bu sorunların bir boyutunu da ülkelerin deniz etki alanlarına ilişkin sorunlar oluşturmaktadır. Balkanlarda yaşanan bu sorunlar geçmişten günümüze değin Balkan coğrafyasında istikrarsızlığa yol açmıştır. Balkanlardaki bu istikrarsız yapının neden ve sonuçlarının anlaşılması için yaşanan bu sorunların etraflıca ortaya konması gerekmektedir. Bu bağlamda henüz günümüzde de çözüme kavuşmamış olan YunanistanArnavutluk deniz sınırına ilişkin sorun çerçevesinde bu ülkelerin sorunlu deniz alanlarının, sorunun nedenlerinin, kapsamının ve sonuçlarının; söz konusu deniz alanına ilişkin taraflarca ortaya atılan argümanların ortaya konması önem arz etmektedir. Bu çalışmada iki komşu ülke olan Yunanistan ve Arnavutluk arasındaki bugün hala daha çözüme kavuşamamış olan sorunlu deniz alanı, bu sorunun ortaya çıkışı, 2009 tarihli uygulamaya konmayan deniz sınırı anlaşması, tarafların soruna ilişkin argümanları ele alınacak ve taraflarca Adalet Divanı’na taşınan sorunun Adalet Divanı’nın deniz yetki alanlarının sınırlandırılmasına dair benzer davalarda vermiş olduğu kararları çerçevesinde söz konusu deniz sınırı sorununa ilişkin olarak verebileceği olası karara yönelik bir çıkarımda bulunmaya çalışılacaktır. | en_US |
| dc.description.abstract | From the past to the present, a number of problems have been between the Balkan States. One of the dimensions of these problems, which are mostly based on ethnic and religious origin between the parties, are the problems related to the maritime zones. These problems in the Balkans have led to instability in the Balkan geography from the past to the present. In order to understand the causes and consequences of this unstable structure in the Balkans, it is necessary to thoroughly identify these problems. In this context, within the framework of the problem related to the Greek-Albanian maritime border which has not yet been resolved today, it is important to set forth the problematic maritime zone between these countries, the causes, scope and consequences of the problem, as well as the arguments put forward by the parties regarding the issue. In this study, the problematic maritime zone today still be unsolved between two neighbouring countries Greece and Albania, the emergence of this problem, maritime border agreement dated 2009 which has not been implemented, the arguments of the parties for the issue will be discussed and it will be tried to make a prediction of the possible decision of the Court of Justice regarding the maritime border issue, within the framework of the decisions of the Court of Justice in similar cases regarding the delimitation of maritime zones. | en_US |
